Non-JS test is being tested with JavaScript

      This test has one background which is used for two empty scenarios. One of these runs with javascript, the other does not.

      Unfortunately, line 1 of the test also has a javascript tag, which means that the test is run with Javascript both times, and is never tested without.

      This is a 2.9 regression caused by MDL-49412 and the user menu.
